Garanzia e Diritto di Recesso
DIRITTO DI RECESSO
Il cliente può esercitare il Diritto di Recesso entro 14 giorni dalla consegna del prodotto, richiedendo la restituzione ai fini del rimborso
(D. Lgs. n. 206/2005, Codice del consumo) oppure il cambio articolo richiedendo via e-mail a info@ledisquestore.com presentando una dichiarazione della sua decisione di recedere dal contratto (art. 54 D. Lgs. n. 206/2005, Codice del consumo).
A meno che la restituzione sia conseguente al ricevimento di prodotti difettosi, danneggiati in fase di trasporto o a un errato invio, le spese di spedizione
per la restituzione sono carico del cliente (art. 57 D. Lgs. n. 206/2005, Codice del consumo).
Il cliente si impegna a restituire il prodotto (o consegnarlo in negozio o ad un terzo autorizzato dal negozio stesso a riceverlo) a Le Disque Record Store
Via Scuderlando 276, 37135 Verona (VR) entro 14 giorni dalla data in cui è pervenuta la comunicazione di recedere dal contratto ai sensi dell'articolo 54.
Il Diritto di Recesso è sottoposto alle seguenti inderogabili condizioni:
- È applicabile solo al prodotto acquistato nell'integrità delle dotazioni. Non è possibile esercitarlo su una parte di esso (esempio accessori, software allegati, e altro), non sono previsti rimborsi parziali.
- L'articolo acquistato deve essere restituito integro e completo in tutte le sue parti (compresi imballo originale e buste, eventuale documentazione e dotazione accessoria come manuali, cavi, ecc.)
- Il bene va restituito in perfetto stato di conservazione, quindi deve essere stato custodito o utilizzato con la normale operativita', non verranno accettati
prodotti con segni di usura, abrasioni, graffi, o imbrattati.
Il Diritto di Recesso decade in mancanza della condizione essenziale dell' integrità del prodotto e della dotazione, ovvero nei casi in cui venga accertata la mancanza della confezione esterna o dell'imballo originale interno, l'assenza di elementi integrati del prodotto (accessori, manuali...) o anomalie
sullo stesso, il danneggiamento per cause non imputabili al suo trasporto e uno stato di sporcizia (conseguente ad un suo utilizzo o ad una conservazione non ottimali) che ne abbia compromesso l'integrità. In tali casi ci riserviamo di addebitare costi di ricondizionamento ed igienizzazione
dello stesso al fine di ripristinarlo alle normali condizioni di conformità.
Il cliente è responsabile unicamente della diminuzione del valore dei beni risultante da una manipolazione dei beni diversa da quella necessaria per
stabilire la natura, le caratteristiche e il funzionamento dei beni.
Sono esclusi dal diritto di recesso prodotti audiovisivi o software informatici consegnati sigillati, prodotti realizzati su misura per esigenze personali del
consumatore (es. Flight case su misura), merce sigillata che, per motivi di protezione della salute o igiene non è idonea ad essere restuita (cuffie
auricolari/archetti microfono…) a meno di una congrua e concordata diminuzione di valore. Non è applicabile il Recesso nel caso di acquisti "B2B",
ossia per forniture di beni fatturati ad aziende o professionisti, salvo particolariaccordi tra le parti.
Tutte le spese di spedizione di trasporto derivanti dalla restituzione del bene verso il nostro negozio così come i costi di ricondizionamento ed
igienizzazione del prodotto sono a carico del cliente (art. 63 e 67 D. Lgs. n. 206/2005, Codice del consumo).
I rimborsi dell'importo pagato, spese di spedizione iniziale al cliente incluse, verranno effettuati a mezzo storno, entro 14 giorni dal rientro in negozio del
bene restituito. In particolare, per articoli pagati con PayPal o carta di credito su circuito Nexi, i rimborsi saranno emessi stornando direttamente al circuito / portale tramite il quale il pagamento dell'ordine è transitato, sarò poi compito dell'ente riversare il denaro sullo strumento utilizzato per il prelievo del denaro.
In caso di pagamento a mezzo bonifico bancario, ricarica alla nostra postepay aziendale, oppure contrassegno, il rimborso avverrà tramite bonifico
bancario ed il cliente è tenuto a comunicare gli estremi per il versamento.
GARANZIA
Sostituzione gratuita e rimborso della spedizione di rientro per tutti i prodotti che presentano difetti di fabbricazione o funzionamento nei primi 14 giorni
dalla consegna, con termine ultimo di riconsegna in negozio entro e non oltre il 30° giorno, effettueremo verifiche sulle condizioni estetiche e
di funzionamento non conformi segnalateci dall'acquirente, al fine di stabilire la responsabilità e la natura di tali non conformità. NB: le sostituzioni in caso di doa (dead on arrival: prodotto non funzionante alla prima accensione), fatta salva la sussistenza dei presupposti per l'applicazione del dlgs n. 24/02, saranno effettuate solo se espressamente previste dal produttore. Precisiamo inoltre che, qualora si rinunciasse alla sostituzione optando per il rimborso, ripensando di fatto sull'acquisto, il costo di trasporto è a carico del cliente.
Per qualsiasi tipo di controversia la competenza territoriale inderogabile è del giudice del luogo di residenza o domicilio del consumatore, se ubicati nel territorio dello Stato (art. 66 bis dlgs 206/2005).
- La garanzia legale di conformità è prevista agli artt. 128 ss. del D.Lgs 206/2005, Codice del Consumo così come modificato dal D.Lgs
n. 21/2014. Per appellarsi alla sostituzione o riparazione in garanzia è necessario disporre del packing list o eventuale scontrino / fattura fiscale (elettronica, dal gennaio 2019).
- La garanzia viene fornita secondo le modalità illustrate nella documentazione presente all'interno della confezione del prodotto. Se a seguito di intervento da parte di un centro assistenza autorizzato il difetto dovesse risultare non coperto dalla garanzia convenzionale del produttore, al cliente saranno
addebitati gli eventuali costi di verifica e ripristino richiesti dall'assistenza autorizzata, oltre ai costi di trasporto.
- Ai sensi del del dlgs sopraccitato, la garanzia di 24 mesi si applica al prodotto che presenti un difetto di conformità, purché lo stesso
sia utilizzato correttamente, nel rispetto della sua destinazione d'uso e di quanto previsto nella documentazione tecnica allegata. Tale durata è riservata solo al consumatore privato (persona fisica che acquista la merce per scopi non riferibili alla propria attività professionale, ovvero senza indicare nel modulo d'ordine un riferimento di partita iva), diversamente la durata della garanzia è di 12 mesi. In caso di difetto provvediamo al ripristino della conformità del prodotto mediante riparazione/sostituzione o alla riduzione del prezzo, fino alla risoluzione del contratto e senza spese per il cliente.
- Precisiamo che i tempi di sostituzione (o eventuale riparazione del prodotto) dipendono esclusivamente dal produttore o centro assistenza. nessun rimborso
può esserci richiesto per eventuali ritardi nell'effettuazione di riparazioni o sostituzioni di prodotti in garanzia.
- Nel caso in cui, per qualsiasi ragione, il centro assistenza fosse impossibilitato a ripararlo, il cliente ha diritto alla sostituzione. qualora lo stesso non
fosse più a catalogo, ovvero uscito di produzione, previo consenso del cliente sostituiremo con un pari caratteristiche e valore, diversamente, in accordo con il cliente, rilasceremo un credito valido per l'acquisto di un altro prodotto, di pari importo ed utilizzabile per la restante durata della garanzia di conformità.
- Nei casi in cui l'applicazione delle garanzie preveda la restituzione del prodotto, lo stesso dovrà esserci recapitato nella confezione originale
completa in tutte le sue parti (compresi imballo, eventuale documentazione e dotazione accessoria di manuali, cavi, ecc.). per limitare danneggiamenti alla confezione originale si raccomanda di inserirla in una seconda scatola o rivestirla con pellicola nera o trasparente, assicurata poi con nastro adesivo, evitando così l'apposizione di etichette o nastri adesivi direttamente sull'imballo grafico.
NB: la garanzia legale non si applica su componenti soggetti ad usura, deperimento e sollecitazioni meccaniche (es: cavi, corde e pelli per strumenti musicali,
altoparlanti tweeter e woofer montati su diffusori amplificati o passivi).
È discrezione del centro assistenza autorizzato, eventualmente, determinarne ed imputarne rottura o il cessato funzionamento, ad un difetto di fabbrica o
progettazione.
Si informa il consumatore residente in Europa che la Commissione Europea (Regolamento dell’Unione Europea n. 524/2013) ha istituito una piattaforma online che fornisce uno strumento di risoluzione alternativa delle controversie.
Tale strumento può essere utilizzato dal consumatore europeo per risolvere in via non giudiziale ogni controversia relativa a contratti di vendita di beni
e servizi stipulati in rete o derivante dagli stessi. Di conseguenza, se Lei è un consumatore stabilito in Europa, può usare tale piattaforma per la risoluzione di ogni disputa nascente dal contratto online stipulato su questo sito. WARRANTY AND RETURN POLICY
RIGHT OF WITHDRAWAL
The customer can exercise the Right of Withdrawal within 14 days of delivery of the product, requesting the return for reimbursement
(Legislative Decree no. 206/2005, Consumer Code) or change the article requesting by e-mail to info@ledisquestore.com by presenting a declaration of its decision to withdraw from the contract (art. 54 Legislative Decree no. 206/2005, Consumer Code).
Unless the return is due to the receipt of defective products, damaged during delivery or to an incorrect sending, the shipping costs for the return are charged to the customer (art. 57 Legislative Decree no. 206/2005, Consumer Code).
The customer undertakes to return the product (or deliver it to the shop or to a third party authorized by the shop to receive it) to Le Disque Record Store Via Scuderlando 276, 37135 Verona (VR) within 14 days from the date on which the communication was received to withdraw from the contract pursuant to article 54.
The right of withdrawal is subject to the following mandatory conditions:
- Is applicable only to the product purchased in the integrity of the equipment. It is not possible to exercise it on a part of it (e.g. accessories, attached software, and more), there are no partial refunds.
- The purchased item must be returned intact and complete in all its parts (including original packaging and envelopes, any documentation and accessory equipment such as manuals, cables, etc.)
- The goods must be returned in perfect condition, therefore they must have been kept or used with normal operations, products with signs of wear, abrasions, scratches, or smeared will not be accepted.
The Right of Withdrawal lapses in the absence of the essential condition of the integrity of the product and of the equipment, or in cases where the absence of the external packaging or the original internal packaging is ascertained, the absence of integrated elements of the product (accessories, manuals ...) or anomalies on the same, damage for reasons not attributable to its transport and a state of dirt (consequent to its use or to a
non-optimal conservation) that has compromised its integrity. In such cases, we reserve the right to charge for reconditioning and sanitizing costs of the same in order to restore it to normal compliance conditions.
The customer is solely responsible for the decrease in the value of the goods resulting from a manipulation of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
Are excluded from the right of withdrawal: audiovisual products or computer software delivered sealed, products made to measure for personal needs of the consumer (eg Flight case made to measure), sealed goods that, for reasons of health or hygiene protection is not suitable for restoration (earphones / microphone headsets ...) unless a reasonable and agreed decrease in value is made.
The Withdrawal is not applicable in the case of "B2B" purchases, that is, for supplies of goods invoiced to companies or professionals, except for special agreements between the parties.
- All shipping costs for the return of the goods to our shop as well as the costs of reconditioning and sanitizing the product are charged to the customer.
(art. 63 and 67 of Legislative Decree no. 206/2005, Consumer Code).
Refunds of the amount paid, including initial shipping costs to the customer, will be made by cancellation, within 14 days of the return of the returned goods to the store.
In particular, for items paid by PayPal or credit card on the Nexi circuit, refunds will be issued by transferring directly to the circuit / portal through which the payment of the order has passed, I will then
be the task of the institution transfer the money to the instrument used to withdraw the money. In case of payment by bank transfer, top-up to our corporate postepay, or cash on delivery, the refund will
be made by bank transfer and the customer is required to communicate the details for the payment.
WARRANTY
Free replacement and reimbursement of the return shipment for all products that have manufacturing or operating defects in the first 14 days of delivery, with the deadline for return to the shop no later than beyond the 30th day, we will carry out checks on the non-compliant aesthetic and operating conditions reported to us by the buyer, in order to establish the responsibility and nature of these non-conformities. NB: replacements in case of DOA (dead on arrival: product not working on first start), without prejudice to the existence of the conditions for the application of Legislative Decree no. 24/02,
will be carried out only if expressly provided by the manufacturer. Please note furthermore that, should the replacement be waived by opting for a refund, actually rethinking the purchase, the transport cost is charged to the customer.
For any type of dispute, the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the consumer, if located in the territory of the State (art.66 bis of Legislative Decree 206/2005).
- The legal guarantee of conformity is provided for in articles 128 ff. of Legislative Decree 206/2005, Consumer Code as amended by Legislative Decree n. 21/2014. To appeal for replacement or repair
under warranty is necessary have the packing list or any receipt / tax invoice (electronic, from January 2019).
- The warranty is provided in the manner described in the documentation inside the product packaging. If, following intervention by an authorized service center, the defect should result
not covered by the manufacturer's conventional warranty, the customer will be charged for any verification and restoration costs required by authorized assistance, in addition to transport costs.
- Pursuant to the aforementioned Legislative Decree, the 24-month warranty applies to the product that has a lack of conformity, provided that it is used correctly, in compliance with its intended use and as
provided in the attached technical documentation. This duration is reserved only to the private consumer (natural person who purchases the goods for purposes not related to their professional activity, or without
indicating a reference in the order form VAT number), otherwise the warranty period is 12 months. In the event of a defect, we will restore the conformity of the product by repair / replacement or reduce the price,
until the contract is terminated and without cost to the customer.
- We specify that the times of replacement (or possible repair of the product) depend exclusively on the manufacturer or service center. no refund can be requested for any delays in making repairs or replacements
of products under warranty.
- In the event that, for any reason, the service center is unable to repair it, the customer is entitled to replacement. if the same is no longer in the catalog, or out of production, with the customer's consent
we will replace with the same characteristics and value, otherwise, in agreement with the customer, we will issue a valid credit for the purchase of another product, of the same amount and usable for the remaining
duration of the guarantee of conformity.
- In cases where the application of the guarantees provides for the return of the product, the same must be delivered in the complete original package in all its parts (including packaging, any documentation
and accessory equipment of manuals, cables, etc.). to limit damage to the original packaging, it is recommended to insert it in a second box or cover it with black or transparent film, then secured with adhesive tape,
thus avoiding the affixing of labels or adhesive tapes directly on the graphic packaging.
NB: the legal guarantee does not apply to components subject to wear and tear and mechanical stress (e.g. cables, strings and skins for musical instruments, tweeter speakers and woofers mounted on amplified or passive speakers). It is the discretion of the authorized service center, if necessary, to determine and attribute their breakage or discontinued operation, to a manufacturing or design defect.
The costumer live in Europe is informed that the European Commission (European Union Regulation no. 524/2013) has set up an online platform that provides an alternative dispute resolution tool. This tool can be used by the European costumer to resolve non-judicially any dispute relating to contracts for the sale of goods and services entered into on the net or deriving from the same.
Consequently, if you are a consumer established in Europe, it can use this platform to resolve any dispute arising from the online contract entered into on this site. The European ODR platform is available
